Welcome to GōZōN! By using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
1. Overview
GōZōN provides event pass sales and merchandise sales management services (Services) . Our Services are designed to enhance customer events and products, and fans’ purchases of them via web or app interface by ensuring secure access through a One-Time Password (OTP) system.
2. OTP Login System
For security purposes, every time you log in to GōZōN, you will receive a One-Time Password (OTP) via your registered mobile number or email. This OTP is required to complete your login process. By using our Services, you consent to receive OTP messages from GōZōN as part of the authentication process.
3. Message Frequency
The frequency of OTP messages is dependent on your login activity. You will receive a message every time you attempt to log in or perform any action that requires re-authentication.

5. Opt-Out Information
If you wish to opt-out of receiving OTP messages, please note that you will no longer be able to access GōZōN's Services, as these messages are integral to our secure login process. For assistance with opting out, please contact us at Hello@Gozon.me.
6. Message and Data Rates
By using GōZōN's ervices, you acknowledge that message and data rates may apply. These charges are your responsibility and are determined by your mobile service provider. GōZōN is not responsible for any charges that you may incur as a result of receiving OTP messages.
7. Limited License
GōZōN grants you a limited license to access the Services. This license is subject to and conditioned on compliance with these Terms of Use and, to the extent applicable, agreements with our customers that provide events and products.
We try to keep our Services safe, secure, and functioning properly, but we cannot guarantee the continuous operation of or access to our Services. We may terminate any license we have granted to access the Services by providing notice, and the termination of such license shall be effective immediately upon GōZōN providing such notice. Termination of a customer license to access the Services shall be subject to the provisions of our agreement with such customer (Customer Agreement).
8. GōZōN Intellectual Property Rights
GōZōN and our licensors retain all right, title, and interest in and to all Intellectual Property Rights related in and to the Services. Other than the limited license granted under these Terms of Use and/or Customer Agreement, you shall have no other rights in or to GōZōN or our licensor’s Intellectual Property Rights, including (without limitation) the right to copy, distribute, disseminate, monetize or otherwise commercialize any of the Services. The GōZōN logos and names are trademarks of GōZōN and are registered in certain jurisdictions. All other product names, company names, marks, logos, and symbols on the Services may be the trademarks of their respective owners. Nothing in this Terms of Use or in the Customer Agreement grants you a right to use any GōZōN Marks.
9. Your Comments and Ideas
You may submit comments or ideas about the Services, including without limitation about how to improve the Services (collectively, “Ideas”). By submitting any Ideas, you agree that: (a) your disclosure is voluntary, gratuitous, unsolicited, and without restriction and will not place GōZōN under any fiduciary or other obligation, (b) your Ideas do not contain the confidential or proprietary information of third parties, and (c) you grant us a perpetual and royalty-free license to use the Ideas without any additional compensation to you and to disclose the Ideas on a non-confidential basis or otherwise to anyone. You further acknowledge and agree that, by acceptance of your submission, GōZōN does not waive any rights to use similar or related ideas, including those known or developed by GōZōN or obtained from sources other than you.
10. Disclaimers, Limitations; Waivers of Liability
YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK AND ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, NEITHER GōZōN NOR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUBSIDIARIES, PARTNERS AND AFFILIATES WARRANT THAT THE SERVICES WILL ACHIEVE ANY OTHER PARTICULAR RESULT.
YOU HEREBY RELEASE GōZōN AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUBSIDIARIES, PARTNERS AND AFFILIATES FROM ALL CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND OR NATURE, KNOWN OR UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE SERVICES, INCLUDING YOUR INTERACTION WITH THIRD PARTIES. NEITHER WE NOR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUBSIDIARIES, PARTNERS AND AFFILIATES WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES IN ANY WAY WHATSOEVER ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SERVICES. WITHOUT LIMITING THE FOREGOING, GōZōN AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUBSIDIARIES, PARTNERS AND AFFILIATES WILL HAVE NO LIABILITY TO ANY PARTY RELATING IN ANY WAY TO ANY DELAY IN PROVIDING ANY ASPECT OF THE SERVICES OR TO THE UNAVAILABILITY OF THE SERVICES. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
TO THE FULLEST EXTENT PERMITTED BY LAW, THE DISCLAIMERS OF LIABILITY CONTAINED HEREIN APPLY TO ANY AND ALL DAMAGES OR INJURY WHATSOEVER CAUSED BY OR RELATED TO USE OF, OR INABILITY TO USE, THE SERVICES UNDER ANY CAUSE OR ACTION WHATSOEVER OF ANY JURISDICTION, INCLUDING, WITHOUT LIMITATION, ACTIONS FOR BREACH OF WARRANTY, BREACH OF CONTRACT OR TORT. IN NO EVENT SHALL GōZōN OR ANY AFFILIATES BE LIABLE TO YOU FOR MORE THAT $100; provided that some jurisdictions do not allow damages exclusions, so they may not apply to you.
11. Arbitration Rules
Except for actions to protect intellectual property rights and to enforce an arbitrator’s decision hereunder, all disputes, controversies, or claims arising out of or relating to these Terms of Use, the Customer Agreement or any breach thereof shall be submitted to and finally resolved by arbitration under the rules of the American Arbitration Association (“AAA”) then in effect. There shall be one arbitrator, and such arbitrator shall be chosen by mutual agreement of the parties in accordance with AAA rules. The arbitration shall take place in Los Angeles, California, USA, and may be conducted by telephone or online. The arbitrator shall apply the laws of the State of California, USA to all issues in dispute. The controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The findings of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction for enforcement. Enforcements of any award or judgment shall be governed by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs up to $1000.00.
EITHER OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND GōZōN AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S).
You can reject these arbitration provision by mailing or emailing us a written opt-out notice. Your opt-out notice must be postmarked or emailed no later than 30 days after the date you accept the Terms of Use for the first time. You must mail the opt-out notice to GōZōN Inc., 22939 Hawthorne Blvd., Unit 306, Torrance, CA 90505 attn: Legal, or by email to hello@gozon.me. The opt-out notice must state that you do not agree to arbitration and must include your name, address, phone number, and the email address(es) used to log in to your account(s) to which the opt-out applies. You must sign the opt-out notice for it to be effective, which means that if you send it by email, you must send it as an attached document that includes your signature. This procedure is the only way you can opt out of arbitration. Even if you opt out of arbitration, all other provisions of the Terms of Use and Customer Agreement still apply.
12. Jurisdiction and Venue
The courts of Los Angeles County in the State of California, USA and the U.S. District Court for the Central District of California shall be the exclusive jurisdiction and venue for all legal proceedings that are not arbitrated under these Terms of Use or Customer Agreement.
13. Controlling Law
These Terms of Use and the Customer Agreement shall be construed under the laws of the State of California, USA, excluding rules regarding conflicts of law. The application the United Nations Convention of Contracts for the International.
14. General
To the extent allowed by applicable law, the English version of these Terms of Use is binding and other translations are for convenience only. Any unenforceable portion of these Terms of Use shall be enforced to the maximum extent possible, and the remaining portions shall be given full effect. Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to a circumstance beyond our reasonable control.
15. Privacy, Data Access and Ownership
Please make sure to review our Privacy Policy and Data Access and Ownership Policy so you understand our collection, use and disclosure of data obtained from you. By using any of the Services, you acknowledge and agree that your use of any of the Services is subject to our Privacy Policy and Data Access and Ownership Policy. If you do not agree with our Privacy Policy or Data Access and Ownership Policy, you should immediately cease any use of our Services and delete your account, if any, The Privacy Policy and Data Access and Ownership Policy is expressly incorporated into these Terms of Use by this reference.
16. Changes to Terms
GōZōN reserves the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting. Your continued use of GōZōN services after changes have been made constitutes acceptance of the revised terms; if you disagree with the new terms, you should stop using the Services and delete your account.
17. Definitions
“Affiliate” means any entity that, directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with GōZōN.
“Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction.
“Services” means, collectively, all services, applications and products that are accessible through the web or app interface, and all GōZōN Mobile Applications.
“GōZōN Mobile Applications” means all mobile applications published by GōZōN or our Affiliates for access to or use of the Services.
“You” means any person who accesses or uses our Services, including a customer or fan and including any entity or agency on whose behalf any such person accesses or uses our Services.
